Uit deze toelichting volgt dus dat met het voorstel voor een richtlijn werd beoogd ervoor te zorgen dat elke mededeling aan het publiek van een werk, uitgezonderd de distributie van materiële kopieën ervan, valt onder het begrip „mededeling [...] aan het publiek” in de zin van artikel 3, lid 1, van richtlijn 2001/29 en niet onder het begrip „distributie onder het publiek” zoals bedoeld in artikel 4, lid 1, van deze richtlijn.
