129 First, in its action before the General Court, EnBW made no attempt to show that certain individual documents disclosure of which was sought were not covered by that presumption but simply criticised the Commission, in essence, for refusing access to a set of documents in its file, on the basis of general and abstract considerations and suppositions, on the ground that, as the purpose of Regulation No 1049/2001 is to give the fullest possible effect to the right of public access to documents held by the institutions, the Commission was required to grant it such access, unless it were able to show specifically in what way certain individual documents were covered by the exceptions provided for in Article 4(2) and (3) of that regulation.
129 Da una parte, nel suo ricorso dinanzi al Tribunale, l’EnBW non ha affatto intrapreso di dimostrare che taluni singoli documenti di cui era richiesta la divulgazione non rientrassero nella presunzione in parola, ma si era limitata, in sostanza, a contestare alla Commissione di aver rifiutato l’accesso ad un insieme di documenti compresi nel suo fascicolo, sulla base di considerazioni generali ed astratte nonché di supposizioni, secondo il rilievo che, poiché il regolamento n. 1049/2001 è diretto a conferire la più ampia efficacia possibile al diritto di accesso del pubblico ai documenti in possesso delle istituzioni, la Commissione era tenuta a darle un accesso siffatto, salvo dimostrare, in concreto, sotto quale profilo taluni singoli documenti rientrassero nelle eccezioni di cui all’articolo 4, paragrafi 2 e 3, di tale regolamento.EurLex-2 EurLex-2
