72 Welnu, uit deze rechtspraak volgt eveneens, dat de Commissie zich niet op het standpunt kan plaatsen, dat een schijnbaar eenzijdige gedraging van een producent, in het kader van zijn contractuele betrekkingen met zijn wederverkopers, in werkelijkheid de grondslag vormt van een overeenkomst tussen ondernemingen, in de zin van artikel 85, lid 1, van het Verdrag, indien zij niet het bewijs levert dat de andere partijen uitdrukkelijk of stilzwijgend met de handelwijze van de producent hebben ingestemd (zie, in deze zin, arresten BMW Belgium e.a. /Commissie, punten 28-30; AEG/Commissie, punt 38; Ford en Ford Europe/Commissie, punt 21; Metro II, punten 72 en 73; Sandoz, punten 7-12, en Bayerische Motorenwerke, punten 16 en 17, reeds aangehaald).
