Na te hebben opgemerkt dat deze „principiële verplichting” in de onderhavige zaak op basis van geen van de argumenten van de Commissie ter zijde kan worden geschoven en te hebben vastgesteld dat diezelfde Commissie ter terechtzitting had toegegeven dat zij vertragingsrente verschuldigd was vanaf de uitspraak van het arrest van 15 april 2011, waarvan akte is genomen in het proces-verbaal van de terechtzitting, heeft het Gerecht vervolgens op grond daarvan vastgesteld dat over het verschuldigde hoofdbedrag, zoals erkend in de litigieuze beschikking, vertragingsrente moet worden betaald vanaf de uitspraak van het arrest van 15 april 2011, aangezien partijen het op dit punt eens zijn, en wel „ongeacht het feit dat die beschikking de enige rechtsgrondslag van de betrokken hoofdschuldvordering vormt”.
Then, having pointed out that none of the arguments put forward by the Commission justified a departure from that ‘basic obligation’ in the circumstances and having held that, on the contrary, the Commission had acknowledged at the hearing that it owed default interest payable as from delivery of the judgment of 15 April 2011 (a point which had been noted in the record of the hearing), the General Court concluded that default interest had to be paid on the principal amount payable, as acknowledged in the contested decision, given the common agreement of the parties in this regard, with effect from 15 April 2011 ‘irrespective of the fact that that decision is the sole legal basis for the principal financial claim at issue’.EurLex-2 EurLex-2
