Jag anser inte, såsom Europeiska domstolen för de mänskliga rättigheterna förefaller ha gjort,(35) att samma procentandel (i förevarande fall 25 procent) ska tillämpas oberoende av storleken på det icke anmälda beloppet. Däremot förefaller det enligt min mening som att en sanktionsavgift som uppgår till 60 procent av hela summan när den överstiger 50 000 euro, möjligen föranledd av en förmodan om att andra överträdelser eller en avsikt att begå sådana överträdelser föreligger, står på gränsen till en åtgärd av förverkande natur för att enbart beivra ett åsidosättande av anmälningsplikten och inte skapar en rättvis balans mellan allmänintresset och skyddet av rätten till egendom som fastställs i artikel 17 i stadgan.
Although I do not think, as the European Court of Human Rights seems to do, (35) that the same percentage (in this case 25%) should be applied whatever the undeclared amount, I consider that a fine of 60% of the entire sum, where it is more than EUR 50 000 – perhaps motivated by the presumed existence of other offences or of intent to commit such offences – verges on a confiscation measure to penalise a mere failure to comply with the obligation to declare and does not strike a fair balance between the requirements of general interest and the requirement of the protection of the right to property enshrined in Article 17 of the Charter.EurLex-2 EurLex-2
