EG-domstolens beslut innebär att vi kan skönja två grundläggande kriterier som dessa förmåner måste uppfylla för att betraktas som förmåner som inte går att exportera och följaktligen utgör undantag från den allmänna principen om att sociala förmåner kan exporteras: förmånernas särskilda karaktär i den berörda medlemsstaten, det faktum att förmånstagaren inte betalar några avgifter för dem, med andra ord att de finansieras genom, och på grundval av, allmän beskattning i den berörda medlemsstaten, och slutligen – och som en kompletterande faktor – det faktum att beloppet ligger i linje med den minimiinkomst som krävs för att leva under rådande ekonomiska förhållanden i den medlemsstat som beviljar förmånerna.
The decisions of the Court of Justice have made it possible to single out two essential characteristics which these benefits must exhibit in order to be considered as non-exportable and, therefore, to enjoy derogations from the general principle of the exportability of social benefits: their special character in the Member State concerned; the fact that the beneficiary does not contribute to them, in other words that they are funded from, and on the basis of, general taxation in the Member State concerned; and, finally – and as a supplementary factor – the fact that the amount is in line with the minimum necessary income required to live in the economic environment of the country granting the benefits.Europarl8 Europarl8
