39 Nach alledem ist auf die zweite Frage zu antworten, dass Art. 96 Abs. 2 des Zollkodex dahin auszulegen ist, dass ein Unterfrachtführer wie der des Ausgangsverfahrens, der zum einen dem Hauptfrachtführer die Waren zusammen mit dem Versanddokument auf dem Parkplatz der Bestimmungszollstelle übergeben und zum anderen diese Waren anlässlich einer Weiterbeförderung erneut übernommen hatte, nur dann verpflichtet war, sich zu vergewissern, dass sie bei der Bestimmungszollstelle gestellt worden waren, und – wenn dies nicht der Fall war – dafür haftbar gemacht werden kann, falls er bei der neuerlichen Übernahme dieser Waren wusste, dass das Versandverfahren nicht vorschriftsgemäß beendet worden war. Dies zu prüfen, ist Sache des vorlegenden Gerichts.
