De problematiek waarvoor de nationale rechter zich ziet gesteld, lijkt te zijn of de bestaande rechtspraak van het Bundesgerichtshof, dat bij het kopiëren van analoog naar analoog met behulp van een reeks apparaten (bijvoorbeeld scanner, computer en printer) de heffing slechts mag gelden voor het apparaat waarmee een beeld van het originele document kan worden verkregen (in het voorbeeld: de scanner), verenigbaar is met de richtlijn, zoals de leveranciers betogen, dan wel of, zoals VG Wort betoogt, de heffing gespreid moet worden over alle apparaten in de reeks, naargelang de mate van het gebruik dat van elk wordt gemaakt.
