67 Mitsdien moet op de vierde vraag worden geantwoord, dat richtlijn 74/329/EEG en de artikelen 30 en 36 EEG-Verdrag aldus moeten worden uitgelegd, dat een maatregel waarbij een Lid -Staat voor een produkt als guarmeel, wanneer dit wordt aangewend in het kader van een vermageringsmethode, een vergunning voor het in de handel brengen verlangt en dit produkt onder het apothekersmonopolie brengt, ongeacht hoe dit produkt overigens naar nationaal recht wordt gekwalificeerd, niet binnen de werkingssfeer van de richtlijn valt, maar wel een invoerbelemmering kan opleveren .
