35 Waar dus een nationale bepaling het belastingtarief "voor binnenlandse naamloze vennootschappen waarvan de aandelen aan het einde van het belastingtijdperk aan toonder luiden en niet zijn genoteerd aan de beurs van Athene, en voor buitenlandse vennootschappen en lichamen met winstoogmerk op 40 %"(11) van het belastbaar inkomen vastlegt, terwijl dit tarief voor "de overige binnenlandse naamloze vennootschappen op 35 %"(12) wordt bepaald, houdt zij openlijk een ongelijke behandeling in van binnenlandse en buitenlandse vennootschappen.
35 Therefore, if a national provision relating to the taxation of legal persons imposes a tax rate of 40% `in respect of domestic public limited companies the shares of which, at the end of the accounting period, are bearer shares not quoted on the Athens Stock Exchange, and in respect of foreign companies and organisations operating with a view to profit', (11) but 35% `in respect of other domestic public limited companies', (12) it is laying down overtly unequal treatment between domestic and foreign public limited companies.EurLex-2 EurLex-2
