37 Mitsdien moet op de tweede vraag worden geantwoord, dat artikel 36, lid 3, derde alinea, van verordening nr. 222/77 aldus moet worden uitgelegd, dat het niet van toepassing is wanneer de lidstaat waartoe het kantoor van vertrek behoort, op voor douanevervoer aangeboden goederen rechten heeft geïnd hoewel aan de aangever geen termijn was verleend om het bewijs te leveren van de plaats waar de overtreding of onregelmatigheid daadwerkelijk is begaan, overeenkomstig de vereisten van artikel 11 bis, lid 2, van verordening nr. 1062/87, en dat in een dergelijk geval de terugbetaling van de onregelmatig geïnde rechten niet afhankelijk is van de voorwaarde, dat de door de aangever verschuldigde rechten zijn betaald in de lidstaat waar de overtreding heeft plaatsgevonden.
37 The answer to Question 2 must therefore be that the third subparagraph of Article 36(3) of Regulation No 222/77 is to be interpreted as not applying to a case in which the Member State to which the office of departure belongs has recovered duty in respect of goods cleared for the Community transit procedure even though the principal has not been set a time-limit for furnishing proof of the place where the offence or irregularity was actually committed, in accordance with Article 11a(2) of Regulation No 1062/87, and in such a case the refund of the duty irregularly recovered is not subject to the condition that the duty due from the principal has been paid in the Member State where the offence was committed.EurLex-2 EurLex-2
