60 Zoals uit de analyse van het eerste middel van de hogere voorziening volgt, dient, om uit te maken of de inbreukmaker zijn marktgedrag zelfstandig bepaalt, rekening te worden gehouden met alle relevante factoren betreffende de economische, organisatorische en juridische banden tussen deze inbreukmaker en zijn overkoepelende entiteit, die in elk concreet geval anders kunnen zijn en waarvan dus geen uitputtende lijst kan worden opgesteld (zie in die zin reeds aangehaalde arresten Akzo Nobel e.a. /Commissie, punten 73 en 74; Elf Aquitaine/Commissie, punt 58, en Alliance One International en Standard Commercial Tobacco/Commissie en Commissie/Alliance One International e.a., punt 45).
60 As is apparent from the analysis of the first ground of appeal, in order to establish whether the author of the infringement decides independently upon its own conduct on the market, account must be taken of all the relevant factors relating to the economic, organisational and legal links which tie that author to its holding entity, which may vary from case to case and cannot therefore be set out in an exhaustive list (see, to that effect, Akzo Nobel and Others v Commission, paragraphs 73 and 74; Elf Aquitaine v Commission, paragraph 58; and Alliance One International and Standard Commercial Tobacco v Commission and Commission v Alliance One International and Others, paragraph 45).EurLex-2 EurLex-2
