19 In de eerste plaats moet worden beklemtoond, dat het Hof sinds het arrest van 20 september 1990, Sevince (C-192/89, Jurispr. blz. I-3461, punt 26), steeds heeft geoordeeld, dat artikel 6, lid 1, van besluit nr. 1/80 in de lidstaten rechtstreekse werking heeft, zodat Turkse onderdanen die aan de voorwaarden van dat artikel voldoen, zich rechtstreeks kunnen beroepen op de rechten die de drie onderdelen van deze bepaling hun geleidelijk verlenen, afhankelijk van de duur die zij in de lidstaat van ontvangst in loondienst werkzaam zijn (zie laatstelijk arresten van 30 september 1997, Günaydin, C-36/96, Jurispr. blz. I-5143, punt 24, en Ertanir, C-98/96, Jurispr. blz. I-5179, punt 24).
19 The first point to be noted is that since the judgment in Case C-192/89 Sevince v Staatssecretaris van Justitie [1990] ECR I-3461, paragraph 26, the Court has consistently held that Article 6(1) of Decision No 1/80 has direct effect in the Member States and that Turkish nationals who satisfy its conditions may therefore rely directly on the rights which the three indents of that provision confer on them progressively, according to the duration of their employment in the host Member State (see, most recently, Case C-36/96 Günaydin v Freistaat Bayern [1997] ECR I-5143, paragraph 24, and Case C-98/96 Ertanir v Land Hessen [1997] ECR I-5179, paragraph 24).EurLex-2 EurLex-2
