Une telle mesure ne saurait être regardée comme portant une atteinte excessive aux prétentions légitimes des travailleurs mis à la retraite d’office du fait qu’ils ont atteint la limite d’âge prévue, dès lors que la réglementation pertinente ne se fonde pas seulement sur un âge déterminé, mais prend également en considération la circonstance que les intéressés bénéficient, au terme de leur carrière professionnelle, d’une compensation financière au moyen de l’octroi d’une pension de retraite, telle que celle prévue par le régime national en cause au principal (voir, en ce sens, arrêt Palacios de la Villa, précité, point 73).
Such a measure cannot be regarded as unduly prejudicing the legitimate claims of workers subject to compulsory retirement because they have reached the age limit provided for; the relevant legislation is not based only on a specific age, but also takes account of the fact that the persons concerned are entitled to financial compensation by way of a retirement pension at the end of their working life, such as that provided for by the national legislation at issue in the main proceedings (see, to that effect, Palacios de la Villa, paragraph 73).EurLex-2 EurLex-2
