43 Met het eerste onderdeel van het derde middel verwijt rekwirante het Gerecht dat het niet is ingegaan op haar argument dat zij vóór de vaststelling van de litigieuze beschikking had moeten worden gehoord, ondanks het bestaan van het arrest Limburgse Vinyl Maatschappij e.a. /Commissie, reeds aangehaald, omdat de administratieve procedure onregelmatig was verlopen vanwege de gebrekkige toegang tot het dossier in een stadium voorafgaand aan de vaststelling van deze beschikking, zodat de geldigheid van de maatregelen ter voorbereiding daarvan was aangetast, en aangezien deze onregelmatigheden nog vóór de vaststelling van de litigieuze beschikking door het Gerecht waren geconstateerd in het arrest van 29 juni 1995, Solvay/Commissie (T‐30/91), reeds aangehaald.
43 By the first part of the third ground of appeal, Solvay claims that the General Court did not address Solvay’s argument that it should have been heard before the contested decision was adopted, notwithstanding Limburgse Vinyl Maatschappij and Others v Commission, since the administrative proceeding had been affected by irregularities, stemming from the lack of access to the file at a stage prior to the decision’s adoption, which affected the validity of the preparatory measures for the decision, and since those irregularities had been established by the General Court before the contested decision was adopted, in Case T‐30/91 Solvay v Commission.EurLex-2 EurLex-2
