Zo stellen verzoeksters in hun verzoekschriften, dat "de dwaling ten aanzien van het recht is toe te schrijven (...) aan het feit, dat de Commissie van mening is, dat (...) zij zich kan baseren op na het verstrijken van deze termijn vastgestelde criteria", dat "de Commissie bij het verstrijken van de termijn (...) door een groot gebrek aan vooruitziendheid de wezenlijke karakteristieken van de bedoelde campagne wilde wijzigen op basis van de door haar op 6 juni 1990 vastgestelde nieuwe criteria (...)", en dat "het handelen van de Commissie erin bestond, dat zij (...) na meer dan vier maanden (...) liet weten, dat zij van mening was veranderd en vooral dat zij de bijstand niet toekende, terwijl de campagne reeds was begonnen (...)"
Thus, the applicants submit in their applications that "the error in law is due ... to the fact that the Commission takes the view that ... it may rely on criteria adopted after the expiry date of the period in question" (6), that "on the expiry of the period ... the Commission, on the basis of new criteria which it had adopted on 6 June 1990, wished to amend the essential characteristics of the fishing season in question, owing to a serious lack of foresight ..."
